Mandatory Reporters of Child Abuse and Neglect

Idaho Code § 16-1605 sets forth a list of professionals required to report suspected child abuse and neglect (including sexual abuse) to authorities. The list includes medical care providers, teachers and daycare personnel, social workers, and law enforcement personnel. In addition, any person who has reason to believe that a child has been abused, abandoned, or neglected is required to report.

Reports must be made within 24 hours. Failure to report is a misdemeanor.

Sexual Abuse and Exploitation

Idaho Code § 16-1602 provides that the term “abuse” applies to any case in which a child has been the victim of sexual conduct, including rape, molestation, incest, prostitution, obscene or pornographic photographing, filming or depiction for commercial purposes, or other similar forms of sexual exploitation that harms or threatens the child’s health, welfare, or mental health.
