Mandatory Reporters of Child Abuse and Neglect

North Dakota Cent. Code § 50-25.1-03 sets forth a list of professionals who are required to report suspected child abuse and neglect (including sexual abuse) to authorities. The list includes medical and mental health care providers, religious practitioners, religious practitioners, school teachers and administrators, social workers, foster parents, law enforcement officers, and members of the clergy.

In addition, any other person who has reasonable cause to suspect that a child is abused or neglected may report.

Reports must be made immediately. Failure to report is a misdemeanor.

Sexual Abuse and Exploitation

North Dakota Cent. Code § 50-25.1-02 provides that ‘sexually abused child’ means an individual younger than age 18 who is subjected by a person responsible for the child’s welfare or by any individual to sexual abuse, as described in §§ 12.1-20-01 through 12.1-20-07 and §§ 12.1-20-11 through 12.1-20-12.2, or sexual exploitation, as described in chapter 12.1-27.2.
